Acceptance of Terms

By accessing and using the Land Direct USA customer portal ("Portal"), you agree to be bound by these Terms of Use. If you do not agree to these terms, please do not use the Portal. This Portal is provided by Land Direct USA, LLC and BDAVIS EV LLC ("we," "our," or "us").

Portal Purpose

This Portal is provided as a convenience to our customers to:

• View your property purchase and loan information
• Review your payment history
• Access payment options and instructions
• Download documents related to your account (when available)
• Update your contact information

The Portal is intended for use by customers who have purchased property from Land Direct USA or BDAVIS EV LLC under an owner-financed agreement.

Account Access

To access the Portal, you must log in using your registered email address and PIN (the last 4 digits of your phone number on file). You are responsible for:

• Maintaining the confidentiality of your login credentials
• All activities that occur under your account
• Notifying us immediately if you believe your account has been compromised
• Keeping your contact information current and accurate

Accuracy of Information

While we strive to ensure the accuracy of information displayed in the Portal, the information provided is for your convenience and reference. Your original Land Contract and related documents remain the official record of your agreement with us. If you notice any discrepancies, please contact us immediately.

Payment Information

The Portal displays payment options but does not directly process payments. Payments made via PayPal, credit card, check, or wire transfer are subject to the terms and conditions of those respective payment processors. We are not responsible for errors or delays caused by third-party payment services.

Payment processing times vary by method. Mailed checks require additional processing time. Your payment is not considered received until it has been processed and posted to your account.

Acceptable Use

You agree not to:

• Access or attempt to access accounts that do not belong to you
• Use the Portal for any unlawful purpose
• Attempt to interfere with, compromise, or disrupt the Portal's security or functionality
• Use automated tools to access the Portal without our permission
• Share your login credentials with others

Availability

We strive to keep the Portal available at all times, but we do not guarantee uninterrupted access. The Portal may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We are not liable for any inconvenience caused by Portal unavailability.

Limitation of Liability

The Portal is provided "as is" without warranties of any kind, either express or implied. To the fullest extent permitted by law, we disclaim all warranties and shall not be liable for any damages arising from your use of the Portal, including but not limited to direct, indirect, incidental, or consequential damages.

This limitation does not affect your rights under your Land Contract or any applicable consumer protection laws.

Modifications

We reserve the right to modify these Terms of Use at any time. Changes will be effective when posted to the Portal. Your continued use of the Portal after changes are posted constitutes your acceptance of the modified terms.

Governing Law

These Terms of Use are governed by the laws of the State of Florida, without regard to conflict of law principles. Any disputes arising from these terms or your use of the Portal shall be resolved in the courts of Manatee County, Florida.
